McAutumn LLC owns or licenses original product photographs, videos, descriptions, Website copy, graphics, logo/branding elements, and other protected content. Purchase of a physical Product does not transfer copyright or a license to reproduce Seller’s photographs or listing copy.
Without prior written permission and except where applicable law permits otherwise, users may not copy, scrape, mirror, remove watermarks from, republish, commercially exploit, create a competing catalog from, or use McAutumn content to market another physical item as if it were the Product photographed by McAutumn.
A copyright owner or authorized agent who believes material on the Website infringes copyright may send a notice to:
[DMCA/IP EMAIL — TO BE COMPLETED]
[BUSINESS/DMCA AGENT ADDRESS — TO BE COMPLETED]
The notice should contain the information required by 17 U.S.C. § 512(c)(3), including identification of the copyrighted work, identification/location of the allegedly infringing material, contact information, a good-faith statement, an accuracy/authority statement under penalty of perjury, and physical or electronic signature.
DO NOT PUBLISH A CLAIM THAT McAUTUMN HAS A REGISTERED DMCA DESIGNATED AGENT UNLESS REGISTRATION HAS ACTUALLY BEEN COMPLETED AND IS CURRENT. If McAutumn operates user-directed content/storage for which it seeks 17 U.S.C. § 512(c) safe-harbor protection, counsel/owner should complete and maintain Copyright Office designated-agent registration and replace this paragraph with the registered agent’s public details and Registry reference.
Where material is removed in response to a qualifying DMCA notice and the statutory counter-notification procedure applies, the affected content provider may submit a counter-notification containing the information required by 17 U.S.C. § 512(g). Seller may forward the counter-notification and restore material as permitted or required by applicable law.
Where legally applicable to a service involving third-party content, Seller may adopt and reasonably implement a policy for termination in appropriate circumstances of repeat infringers. Seller may also remove access to content or services in response to substantiated infringement.
Complaints concerning trademark, false designation, unauthorized use of Seller photographs/listings, or other intellectual-property matters should identify the right asserted, the challenged material, the basis for the claim, and claimant contact information. Seller may request reasonable evidence of ownership/authority.
Knowingly material misrepresentations in a DMCA notice or counter-notice may have legal consequences under applicable law. Seller may preserve abusive-notice records and assert available remedies.
