1. Scope

These Terms govern access to and use of the McAutumn Vintage Website. Purchases are additionally governed by the Terms of Sale and incorporated policies.

2. Limited Permission

McAutumn grants users a limited, revocable, non-exclusive, non-transferable permission to view and use the Website for lawful personal shopping and ordinary business inquiry. No ownership of Website content is transferred.

3. Prohibited Conduct

You must not, except where applicable law expressly prohibits restriction:

• obtain unauthorized access to any server, account, admin panel, database, API, payment flow, or security control;

• interfere with, overload, disrupt, probe, scan, attack, or introduce malware into the Website;

• circumvent rate limits, access controls, robot exclusions, anti-bot measures, or technical restrictions;

• create false accounts, place fraudulent orders, test stolen payment credentials, impersonate another person, or submit materially false shipping/claim information;

• systematically scrape, harvest, mirror, copy, republish, or create a substitute catalog/database from Product listings, photographs, descriptions, prices, or metadata;

• remove watermarks, rights-management information, or notices;

• use Website content to market a different physical Product in a way likely to confuse buyers as to identity, provenance, seller, or condition; or

• use the Website for unlawful sanctions evasion, fraud, theft, infringement, harassment, or other unlawful activity.

4. Intellectual Property

Website photographs, videos, copy, product descriptions, graphics, logos, branding, selection/arrangement, and original design elements are owned by or licensed to McAutumn and protected as applicable. Product ownership does not transfer copyright in Seller’s photographs, listing text, or other content.

5. AI / Dataset Use

To the extent enforceable under applicable law, Website content may not be systematically copied, scraped, downloaded, licensed onward, or used to train, fine-tune, ground, evaluate, benchmark, or populate a machine-learning or generative-AI model or dataset without McAutumn’s prior written permission. This restriction does not prohibit uses that applicable law makes non-waivable.

6. Product Images and Third-Party Marks

Reference to a manufacturer, designer, artist, trademark, or brand identifies or describes a Product and does not imply affiliation, sponsorship, or endorsement unless expressly stated. Third-party trademarks remain property of their owners.

7. User Communications and Submitted Materials

If you send photographs, video, claim materials, reviews, or other content to Seller, you represent that you may lawfully provide it. You grant Seller a non-exclusive license to use submitted material as reasonably necessary to administer the transaction, investigate claims, prevent fraud, respond to chargebacks, obtain professional opinions, comply with law, and defend legal rights. Seller will not obtain broader public promotional rights merely from a private support submission unless separately agreed.

8. Availability and Errors

Website availability is not guaranteed. Seller may correct technical, pricing, inventory, or content errors and may suspend or change features. Purchase cancellation and refund consequences are governed by the Terms of Sale and applicable law.

9. Security and Monitoring

Seller may maintain security logs and use reasonable technical measures to detect fraud, abuse, scraping, attacks, or unauthorized access, subject to the Privacy Policy and applicable law.

10. Third-Party Links and Services

External sites and providers have their own terms and practices. McAutumn is not responsible for independent third-party content or services except to the extent applicable law imposes responsibility.

11. Disclaimer

The Website is provided on an “as available” basis to the maximum extent permitted by law. Product warranties and liability are governed by the Terms of Sale. Nothing in these Terms disclaims liability that cannot lawfully be disclaimed.

12. Enforcement

Seller may block access, preserve evidence, cancel fraudulent orders, assert intellectual-property rights, and report unlawful conduct to providers or authorities where reasonably appropriate and lawful. Remedies are cumulative to the extent permitted by law.

13. Governing Law and Disputes

New York law governs these Terms to the extent permitted, and the dispute-resolution provisions of the Terms of Sale apply to disputes relating to Website use where legally applicable.
