1. Purpose and Priority

This Rider supplements the Terms of Sale for Consumers located outside the United States. McAutumn’s U.S. voluntary policy remains ALL SALES FINAL, but a Consumer may have mandatory rights under the law that applies to a cross-border distance sale. Nothing in the Terms is intended to waive a right that applicable law makes non-waivable.

If this Rider conflicts with a mandatory local consumer rule, the mandatory rule controls only to the extent required. If no such rule applies, the Terms of Sale and Return & Condition Claims Policy control.

2. EEA Consumers — Distance-Sale Withdrawal

Where the EU Consumer Rights Directive 2011/83/EU as implemented in the Consumer’s applicable EEA jurisdiction governs the transaction, a Consumer ordinarily has 14 days to withdraw from a qualifying distance sales contract without giving a reason, subject to statutory exceptions and local implementation.

For goods, the withdrawal period ordinarily runs from the day the Consumer or a designated third person other than the carrier acquires physical possession, subject to the Directive’s rules for multiple goods/lots and to any applicable national variation.

The Consumer must communicate an unequivocal withdrawal before the applicable period expires. A Consumer may use any legally sufficient statement; Seller should not require an RMA as a condition of the statutory act of withdrawal. Seller may nevertheless issue return instructions/RMA to protect the Product and identify the shipment.

3. EEA Return After Withdrawal

Where EEA mandatory withdrawal law applies, the Consumer generally must send the goods back without undue delay and no later than 14 days after communicating withdrawal, unless Seller has offered to collect them or applicable law provides otherwise.

If Seller has clearly informed the Consumer before purchase that the Consumer bears the direct cost of returning goods, the Consumer bears those direct return costs to the extent permitted by applicable law. For goods that by their nature cannot normally be returned by post, pre-contract disclosures must accurately address return cost/collection obligations as required by applicable law.

4. EEA Diminished Value and Anti-Wardrobing Protection

A statutory withdrawal right is not a free rental right. Where Article 14 or corresponding national law applies, the Consumer may be liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods, provided Seller gave the legally required withdrawal information.

For a one-of-a-kind vintage Product, Seller may document pre-shipment condition and, where lawful, assess actual diminished value caused by event wear, photo/video production use, smoke/perfume/cosmetics/body oils, cleaning, washing, polishing, mounting, installation, alteration, repair, Security Device removal/tampering, new scratches/damage, stretched fabric, stressed clasps/pins, missing parts, or other use beyond necessary inspection. Any deduction must reflect legally supportable diminished value and must not be used as a disguised penalty.

A Security Device does not eliminate a mandatory withdrawal right merely because it is removed unless a specific statutory exception applies; however, removal/use may be relevant evidence of handling and diminished value where law permits.

5. EEA Refund Timing and Delivery Costs

Where EEA withdrawal law applies, Seller will make reimbursements within the legally required period and by a legally permitted method. Seller may withhold reimbursement until the goods are returned or the Consumer supplies sufficient evidence of sending them back where the law permits. Seller need not reimburse a premium delivery upgrade beyond the legally required standard-delivery amount where the Consumer chose a more expensive method and the law permits that exclusion.

6. EEA Transit Risk

Where EEA mandatory consumer law applies, risk of loss or damage ordinarily remains with Seller until the Consumer or a designated third person other than the carrier acquires physical possession. If the Consumer independently commissions a carrier not offered by Seller, the legally applicable exception may transfer risk when goods are delivered to that carrier.

7. United Kingdom Consumers

Where the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply, a Consumer ordinarily has a 14-day cancellation period for qualifying distance goods contracts, subject to statutory exceptions. After cancellation, statutory rules govern the period for sending goods back, refund timing, return costs, and permitted deductions for diminished value caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

UK mandatory transit-risk rules also generally keep goods at the trader’s risk until physical possession by the Consumer or a person identified by the Consumer, subject to the statutory independently commissioned carrier exception.

8. Statutory Exceptions

Mandatory withdrawal/cancellation regimes contain exceptions. Depending on applicable law and facts, examples may include genuinely made-to-consumer-specification or clearly personalized goods and certain sealed hygiene-sensitive goods after unsealing. Seller will rely on an exception only where the Product and transaction actually satisfy the applicable statutory requirements; labeling a normal vintage item “final sale” does not by itself create an EEA/UK statutory exception.

9. Nonconforming or Defective Goods

A statutory withdrawal right is different from statutory conformity/defect rights. Nothing in this Rider replaces mandatory local remedies for goods that legally fail to conform to the contract. Seller may require reasonable evidence and return/inspection cooperation consistent with local law, but will not impose a contractual evidence rule that unlawfully extinguishes a mandatory remedy.

10. Other Countries

Canada, Australia, New Zealand, Switzerland, Israel, and other jurisdictions may provide non-waivable consumer, distance-sales, unfair-practices, warranty, or conformity rights that differ by country, province, state, territory, transaction type, or Product. Seller does not represent that the U.S. ALL SALES FINAL policy overrides such mandatory rights.

Seller may limit destinations offered at checkout when legal obligations, product-safety requirements, taxes, sanctions, customs, product restrictions, return-law administration, or compliance costs make a transaction impracticable. Acceptance of an order does not waive mandatory law.

11. International Return Procedure

Even where a statutory withdrawal right exists, Seller requests that Consumer contact [RETURNS/LEGAL EMAIL — TO BE COMPLETED] promptly so Seller can issue safe packing, carrier, customs-return, and Product-identification instructions. The Consumer must exercise the statutory right within the legally required time; requesting an RMA does not extend the statutory period unless applicable law provides otherwise.

The Consumer should keep all shipping evidence and must return the identical Product. Fraud, substitution, component swapping, deliberate damage, or falsification of return evidence is not protected by a consumer withdrawal statute.

12. Local-Law Review Before Market Expansion

This Rider is a cross-border framework, not a substitute for country-by-country legal review. Before Seller actively targets or localizes a new jurisdiction, counsel should verify required pre-contract information, local-language rules, cancellation forms, return-cost disclosure, product safety, tax/VAT registration, platform obligations, warranty/conformity periods, privacy/cookie rules, and dispute-resolution disclosures.
