ALL SALES FINAL — IMPORTANT
---
McAutumn Vintage sells vintage, antique, collectible, pre-owned, and frequently one-of-a-kind goods. We do not offer change-of-mind returns, fit returns, approval returns, event/wardrobe returns, decorating-trial returns, or temporary-use returns. This Policy provides a limited procedure for qualifying shipping-damage, material-misdescription, undisclosed-material-condition, and authenticity/material-attribution claims. Rights that applicable law makes non-waivable are not excluded.
A Product is not returnable merely because Buyer changes their mind; the item does not fit; a color, patina, texture, scale, style, or age characteristic is disliked; an event or photo shoot ended or was cancelled; the item is no longer needed; Buyer found another item; a designer/client/spouse rejected it; or Buyer expected a vintage item to be new, perfect, or free from disclosed/reasonably visible age-related wear.
Products marked “ALL SALES FINAL,” “AS IS,” or “WITH ALL FAULTS” remain subject only to qualifying contractual claims described below and non-waivable law.
---
The purchase price buys the Product; it does not buy a temporary right of use followed by a return. Contractual return eligibility is lost, to the maximum extent permitted by law, if Buyer or another person uses the Product beyond what is reasonably necessary for immediate indoor inspection.
Prohibited post-delivery use includes wearing or carrying an item at an event; commercial or non-commercial photo/video shoots beyond documenting condition; social-media content production; styling; wardrobe; stage/set use; real-estate/interior staging; mounting/installation; energizing vintage electrical goods; burning candles in or on an item; filling vessels; washing, laundering, dry-cleaning, polishing, restoring, repairing, altering, resizing, sewing, pinning, stretching, gluing, or refinishing; lending, renting, consigning, reselling or listing for resale; and exposure causing new odor, cosmetic residue, body oils, smoke, food, liquid, moisture, pet hair, or other condition change.
Once Buyer submits a claim seeking return, Buyer must immediately stop all use other than reasonable documentation and preservation.
Subject to this Policy, Seller will review a claim alleging:
(a) material carrier/shipping damage existing at delivery;
(b) a material objective discrepancy between the delivered Product and a specific factual description in the listing;
(c) a material condition issue existing at delivery that was not disclosed and was not reasonably visible in the listing photographs/video; or
(d) a material authenticity, maker, origin, period, or attribution issue meeting Section 7.
Minor variations, ordinary vintage wear, disclosed restoration, approximate measurement differences within reasonable measurement tolerance, display/lighting color variation, changing scholarly opinion, or dissatisfaction with a qualified attribution ordinarily do not qualify.
For a U.S. contractual shipping-damage claim, Buyer must notify Seller in writing as soon as reasonably possible and no later than forty-eight (48) hours after recorded delivery, unless non-waivable law provides otherwise.
Buyer must preserve the Product and all outer/inner packaging and provide, where reasonably available:
• photographs of all sides of the unopened outer package before discarding packaging;
• close photographs of dents, tears, punctures, wet areas, crushing, or other package damage;
• the shipping label and tracking number;
• photographs/video of the internal packing arrangement;
• photographs/video of the Product and claimed damage from multiple angles;
• a description of when and how the damage was discovered; and
• any carrier notation, damage report, delivery photograph, or inspection record available to Buyer.
Buyer must not discard packaging, repair the Product, clean the damaged area, or alter evidence before Seller/insurer/carrier has had a reasonable opportunity to review the claim. Seller may request reasonable additional evidence, a carrier inspection, or return under an RMA.
Failure to comply with this evidence procedure may make a voluntary/contractual carrier-damage remedy unavailable where the failure materially prejudices verification, insurance, or carrier recovery. This does not extinguish a remedy that law makes non-waivable.
For an issue that a reasonable inspection would reveal, Buyer must give written notice no later than seventy-two (72) hours after recorded delivery, unless non-waivable law requires otherwise. Buyer must identify the exact listing statement or undisclosed condition at issue and provide clear photographs/video and any relevant measurements.
A condition claim must distinguish pre-existing vintage wear from alleged new or undisclosed damage. Seller may compare the claim with the archived listing, pre-shipment photographs/video, measurements, natural marks, Security Device records, packaging records, and other transaction evidence.
For Buyers outside the United States, Seller requests notice of visible shipping damage, visible condition issues, or material objective misdescription within seven (7) calendar days after delivery so evidence can be preserved. This contractual evidence window does not shorten a mandatory withdrawal, conformity, warranty, or other consumer right that applicable law prohibits Seller from shortening. The International Consumer Rights Rider controls where applicable.
A contractual claim that a Product is materially inauthentic or materially misattributed must be submitted within thirty (30) calendar days after recorded delivery, not purchase, unless non-waivable law requires otherwise.
The claim must identify the specific disputed representation and include a signed written opinion from an independent expert who has at least ten (10) years of specialized experience in the relevant category or comparably substantial recognized professional credentials. The opinion should identify the expert, qualifications, independence, items/material reviewed, methodology, factual basis, reference sources where applicable, conclusion, and material limitations. Seller may reasonably verify the expert’s identity, credentials, independence, and methodology and may obtain a second opinion.
A marketplace’s refusal to list an item, a social-media comment, an automated image search, an unsigned opinion, a general appraiser without relevant category expertise, a disagreement over a qualified attribution, or a later change in scholarship is not by itself conclusive proof of material misdescription.
Where authentication reasonably requires physical examination, Buyer must cooperate with an RMA or mutually reasonable inspection procedure. Buyer must not destructively test the Product without Seller’s prior written approval unless law gives Buyer that right.
Seller may use tamper-evident tags, seals, threads, labels, identifying photographs, serial/model/maker numbers, natural marks, measurements, weight, condition maps, and other non-invasive identifiers.
Buyer must return the identical Product originally delivered. Removal, cutting, transfer, replacement, or tampering with a disclosed Security Device while contractual return eligibility remains possible is evidence of use/handling and may invalidate a voluntary/contractual return to the maximum extent permitted by law.
Product substitution, component swapping, removal of original parts, return of a different example, staged damage, falsified evidence, or alteration of identifying features may result in denial of a contractual refund and referral to payment providers, carriers, insurers, marketplaces, or authorities where reasonably appropriate and lawful.
Buyer must contact Seller at [RETURNS/LEGAL EMAIL — TO BE COMPLETED] before sending any Product back. The claim should include the order number, Product, delivery date, claim category, concise explanation, and required evidence.
Seller may request reasonable additional information. If Seller authorizes physical return, Seller will issue written Return Merchandise Authorization (“RMA”) instructions. An RMA authorizes shipment for inspection only; it is not an admission that a refund is due.
Unless the RMA or mandatory law states otherwise, a U.S. contractual return must be physically tendered to Seller’s approved carrier within two (2) business days after the RMA or return label is issued. The RMA expires if not timely tendered. The claim/RMA period is not a permitted-use period.
Unauthorized returns may be refused, held for instructions, or returned at Buyer’s expense to the extent permitted by law.
Buyer must follow RMA instructions and use the designated carrier/service where specified. The Product must be packed with at least the same degree of protective care reasonably used for shipment to Buyer, using original packing materials where Seller requires them and they remain suitable.
All parts, accessories, certificates, detached components, seller-supplied boxes/pouches, and Security Devices delivered with the Product must be returned unless Seller instructs otherwise. Buyer must not attach a shipping label directly to collectible/original manufacturer packaging or otherwise damage packaging that forms part of the Product’s value.
Seller may document opening and inspection of a return by photography or continuous video. Seller may compare the returned Product with pre-shipment records, listing images, Security Devices, serial/model/maker numbers, dimensions, natural marks, condition characteristics, and packing evidence.
Seller may use a qualified independent specialist when reasonably necessary to determine identity, condition, alteration, or authenticity.
An authorized return must be the identical Product in materially the same condition as delivered, excluding only handling reasonably necessary to identify/document the qualifying issue and change caused solely by the verified issue.
To the extent permitted by law, Seller may deny a voluntary/contractual refund or deduct documented diminished value caused after delivery, including new scratches, chips, bends, pulls, stretched fabric, clasp/pin wear, mounting marks, odors, smoke, perfume, cosmetics, body oils, food/liquid, moisture, cleaning, polishing, laundering, restoration, repair, alteration, missing parts, loss of value from damaged packaging, or removal/tampering with Security Devices.
Where a jurisdiction provides a mandatory withdrawal right, deductions for diminished value will be made only as permitted by that law. For example, where applicable EEA consumer law governs withdrawal, handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods may create diminished-value liability.
If Seller verifies a qualifying material misdescription, qualifying undisclosed material condition, or qualifying shipping damage for which Seller is responsible, Seller will provide the remedy required by applicable law. Where rescission/refund is the applicable remedy, refund will ordinarily be made to the original payment method after return/legally sufficient proof of return and inspection as applicable.
Seller will not deduct ordinary transaction costs from a refund where applicable law requires a full refund for Seller’s verified nonconformity. For a purely voluntary accommodation not required by law, Seller and Buyer may agree to store credit, partial refund, repair contribution, or another resolution.
If Seller issues store credit as a voluntary accommodation, it will be identified as STORE CREDIT and, unless Seller separately establishes a legally compliant gift-card program, will not be sold or marketed to the general public as a gift card or other prepaid product. Seller will honor a valid store-credit balance according to its stated terms. The amount and any applicable expiration, transferability, cash-redemption, replacement, or other terms will be stated clearly and conspicuously in a retainable written or electronic record provided when the credit is issued and will not be changed retroactively. Seller will comply with applicable store-credit and gift-certificate law. Nothing in this paragraph permits Seller to substitute store credit for a cash/original-method refund that applicable law requires without Buyer’s valid agreement.
For an approved contractual return based on Seller’s verified material misdescription or other Seller-responsible qualifying issue, Seller will provide or reimburse reasonable return shipping when required by law or expressly stated in the RMA. For a return arising solely from a mandatory change-of-mind withdrawal right in a jurisdiction where the consumer may lawfully be required to bear direct return costs, Buyer bears those direct costs if Seller gave the legally required advance notice.
Buyer bears costs of unauthorized, improperly packaged, misdirected, or non-qualifying returns to the extent permitted by law.
Except where immediate action is reasonably required for unauthorized payment, a card-network deadline, or non-waivable law, Buyer should provide Seller a reasonable opportunity to inspect and resolve a return/condition claim before filing a chargeback. Seller may submit the accepted policy, archived listing, condition records, shipping records, correspondence, Security Device evidence, and return inspection records in response to a payment dispute.
Seller may refuse future transactions, subject to applicable law, where objective records show confirmed substitution, Security Device tampering, intentionally false non-delivery/damage claims, fraudulent chargebacks, repeated unsupported claims, or use of the return process as a rental/wardrobe/staging mechanism. Good-faith exercise of a lawful consumer right is not return abuse.
Nothing in this Policy waives rights that cannot lawfully be waived. If a mandatory law gives Buyer a longer notice period, withdrawal period, conformity remedy, or other protection, that law controls to the extent applicable. The International Consumer Rights Rider provides additional information for certain non-U.S. transactions.
