1. Scope

This Policy governs shipment and delivery of Products sold by McAutumn LLC. It is incorporated into the Terms of Sale. Mandatory non-waivable consumer law controls where applicable.

2. Shipping Charges

Unless expressly included at checkout, shipping, packing, insurance, signature service, freight, customs, brokerage, storage, remote-area surcharges, and destination charges are separate from the Product price. Where shipping is quoted separately after purchase under the checkout model, the order confirmation and checkout disclosure will state that shipping is separate and must be agreed/paid before shipment.

3. Processing and Shipment Timing

Any stated handling or shipment date is an estimate unless expressly guaranteed in writing. Seller will maintain a reasonable basis for advertised shipment timing and will comply with applicable U.S. rules governing Internet-order shipment, delay notices, consent to delay, cancellation, and prompt refund of unshipped merchandise.

If no specific shipment time is stated for a transaction governed by the FTC Mail, Internet, or Telephone Order Merchandise Rule, Seller intends to operate consistently with the Rule’s default timing requirements. Seller may cancel an order it cannot lawfully or reasonably fulfill and refund amounts required by law.

4. Address Accuracy

Buyer must provide a complete deliverable address, recipient name, phone/email where carrier use is reasonably necessary, and any customs data. Buyer bears reasonable actual costs caused by an incorrect or incomplete address, unauthorized redirect, failure to collect, or similar Buyer-caused delivery failure to the extent permitted by law.

Seller may reject delivery to freight forwarders, mail drops, hotels, temporary addresses, sanctioned/restricted destinations, or addresses that create elevated fraud/loss risk.

5. Carrier and Service

Seller may select the carrier, service level, packaging, signature requirement, insurance, and routing unless otherwise agreed. Buyer must not request a carrier change, redirect, hold, or delivery-address change after shipment without Seller’s written approval. An unauthorized redirect may affect Seller’s ability to assist with a loss claim.

6. U.S. Risk of Loss

For U.S. transactions, unless Seller expressly agrees to a destination contract, the parties intend a shipment contract to the maximum extent permitted by New York UCC § 2-509 and other applicable law. Allocation of transit risk remains subject to contrary mandatory law, Seller’s express written commitments, and any carrier/insurance arrangement.

This clause does not eliminate Seller’s obligation to ship the correct Product with commercially reasonable care or any non-waivable remedy for Seller’s breach.

7. EEA/UK and Other Mandatory Transit-Risk Rules

Where mandatory consumer law provides that goods remain at the trader’s risk until the Consumer or a designated third person obtains physical possession, that mandatory rule overrides the U.S. shipment-contract allocation. The International Consumer Rights Rider applies.

8. Tracking; Delivery Confirmation; Signature

Tracking and delivery confirmation supplied by the carrier may be used as evidence of delivery. Seller may require adult or direct signature for high-value, fragile, theft-sensitive, or otherwise elevated-risk shipments. Buyer must ensure an authorized person is available.

A delivery scan is not irrebuttable where applicable law provides otherwise, but Buyer must promptly report any genuine non-receipt so Seller can preserve carrier evidence and investigate.

9. Package Inspection and Carrier Damage

Buyer should inspect the outside of the package at delivery when reasonably possible. If obvious damage exists, Buyer should photograph it before opening and request that the carrier note visible damage where the carrier permits.

For U.S. contractual shipping-damage claims, written notice and evidence should be supplied within 48 hours after recorded delivery as detailed in the Return & Condition Claims Policy. Buyer must preserve all packaging and not repair, clean, or discard evidence while a claim is being investigated.

10. Missing / Non-Delivery Claims

A Buyer asserting genuine non-receipt must cooperate with reasonable carrier, insurer, payment-provider, and fraud-investigation procedures. Seller maintains a documented internal merchandise-value threshold for enhanced non-delivery verification. At or above that threshold, Seller ordinarily requires both (a) a signed statement of non-receipt and (b) a police/incident report, official claim/reference number, or written confirmation that the relevant authority will not issue such a report, where reasonably obtainable and law permits. Seller may require the same evidence below the threshold when objective risk factors warrant it, and may waive or modify a requirement when applicable law, carrier/insurer/payment-provider rules, accessibility, safety, or the circumstances reasonably require.

These requirements are evidence and fraud-control measures, not categorical conditions that override a non-waivable right or Seller’s delivery obligations under applicable law. The internal threshold may be adjusted prospectively as a risk-control parameter and does not retroactively alter an existing Buyer’s rights. Seller may provide tracking, geolocation/delivery records supplied by the carrier, signature, delivery photographs, address verification, communications, and other relevant evidence to the carrier, insurer, payment provider, or competent authority.

11. Refused or Unclaimed Delivery

Buyer must not refuse a conforming delivery as an unauthorized return method. If a shipment returns because Buyer refused it without authorization, failed to collect it, supplied a bad address, or failed to pay destination charges for which Buyer was responsible, Seller may recover reasonable actual costs to the extent permitted by law. Reshipment may require advance payment of new shipping charges.

12. International Customs and Import

Buyer is the importer of record where applicable and is responsible for lawful importation, destination duties/taxes, customs clearance, permits, and restrictions unless checkout or mandatory law states otherwise. Seller will not falsify value, gift status, origin, contents, or customs classification.

Customs delay is outside Seller’s control, but Seller will comply with legal duties that remain Seller’s responsibility. International Buyer must promptly provide information reasonably required for customs clearance.

13. Restricted or Prohibited Shipments

Seller may refuse or cancel shipments that would violate sanctions, export controls, carrier restrictions, customs law, wildlife/cultural-property restrictions, hazardous-material rules, or other applicable law. If Seller cancels before lawful shipment, Seller will refund amounts as required by law.

14. Large, Fragile, or Freight Items

Furniture, mirrors, marble, oversized ceramics, lighting, and other fragile/large Products may require freight, crating, white-glove service, terminal pickup, special access, or separate insurance. Buyer must disclose stairs, elevator limits, doorway/access restrictions, building delivery rules, and other material constraints before service is booked where relevant.

15. No Guaranteed Event-Date Delivery Unless Written

Seller is not responsible for Buyer’s event, styling, production, installation, photo shoot, holiday, travel, or other deadline unless Seller expressly guarantees a delivery date in a written order confirmation. Expedited shipping does not itself create such a guarantee.
